부칙
이 약관은 <사이트 개설일>부터 시행합니다.
This is an English translation provided for convenience. The Korean version is the legally binding text.
Article 1 Purpose
These Terms of Service set out the conditions of use of the services of "Take2Rent" (the "Site") and the various matters relating to its operation.
Article 2 Definitions
The main terms used in these Terms are defined as follows.
① Member: a person who has agreed to the Site's terms, provided personal information, registered as a member, entered into a use agreement with the Site, and uses the Site. ② Use agreement: the agreement concluded between the Site and a Member in connection with use of the Site. ③ Member ID ("ID"): a unique combination of letters and numbers assigned to each Member to identify the Member and enable use of the service. ④ Password: a combination of letters and numbers chosen by the Member to confirm that the Member matches the assigned ID and to protect the Member's interests. ⑤ Operator: the operator who opens and runs the website on the service. ⑥ Termination: a Member's cancellation of the use agreement.
Article 3 Rules Outside These Terms
The Operator may separately announce operating policies where necessary. Where these Terms and an operating policy overlap, the operating policy prevails.
Article 4 Formation of the Use Agreement
① The use agreement is formed when a person who wishes to register as a Member and use the Site agrees to these Terms and the Operator accepts the application. ② A person who wishes to register as a Member and use the service expresses agreement to these Terms by reading them at the time of application and selecting "I agree" below.
Article 5 Application to Use the Service
① A user who wishes to register as a Member and use the Site must provide the information requested by the Site (user ID, password, nickname, and so on). ② A Member who does not register their own true information — for example by misappropriating another person's information or registering false information — may not assert any rights in connection with use of the Site and may be punished under applicable law.
Article 6 Privacy Policy
Neither the Site nor the Operator holds the password among the personal information provided at registration, and related matters follow the Site's privacy policy. The Operator makes efforts to protect Members' personal information, including membership registration information, in accordance with applicable law.
Protection of Members' personal information follows applicable law and the privacy policy established by the Site.
However, the Operator bears no responsibility for information exposed due to causes attributable to the Member. Where a Member registers or distributes unlawful postings — such as postings that harm public morals or contravene national security — the Operator may, at the request of the relevant authorities, review the Member's data and submit that data to those authorities.
Article 7 Obligations of the Operator
① Where the Operator recognises that an opinion or complaint raised by a Member is justified, the Operator must handle it as promptly as possible. Where prompt handling is difficult for personal reasons, the Operator will do its best by, for example, posting a notice afterwards or sending the Member a message or email. ② To provide the Site continuously and stably, the Operator may require the Site to repair or restore facilities without delay where they fail or are lost. However, operation of the Site may be suspended temporarily in the event of a natural disaster or other unavoidable circumstances affecting the Site or the Operator.
Article 8 Obligations of Members
① Members must comply with these Terms, the various rules established by the Operator, notices, operating policies and other matters announced by the Site, and applicable law. Members must not engage in conduct that interferes with the Site's business or damages the Site's reputation. ② Unless the Site expressly consents, a Member may not transfer or gift their right to use the service or their status under the use agreement to another person, nor offer it as security. ③ Users must take considerable care in managing their ID and password, and may not allow a third party to use their ID without the consent of the Operator or the Site. ④ Members must not infringe the intellectual property rights of the Operator, the Site, or third parties.
Article 9 Service Hours
① Service is in principle available 24 hours a day, year-round, unless there are particular operational or technical impediments. However, the Site may suspend the service temporarily on dates or at times set by the Site for regular system inspection, expansion, or replacement. Temporary suspensions due to scheduled work are announced in advance on the Site's website, so please check it from time to time. ② The Site may suspend the service temporarily or permanently without prior notice in the following cases:
Article 10 Termination of Service Use
① A Member who wishes to terminate the use agreement with the Site must apply online, in person, to cancel their registration. Termination of the use agreement for the Site must be done separately from cancelling use of the Site. ② Because Site-related programs provided by the Site are automatically deleted from the member management screen at the same time as the termination application, the Operator can no longer view the applicant's information.
Article 11 Restrictions on Service Use
Members must not engage in any of the following conduct. Where a Member does so, the Site may restrict the Member's use of the service and take lawful measures, and may terminate the use agreement or suspend the service for a set period. ① Registering false information at sign-up or when changing information afterwards ② Interfering with another person's use of the Site or misappropriating their information ③ Impersonating the Site's management, staff, or affiliates ④ Infringing the personal rights or intellectual property rights of the Site or third parties, or interfering with their business ⑤ Wrongfully using another Member's ID ⑥ Collecting, storing, or disclosing another Member's personal information without their consent ⑦ Conduct objectively judged to be connected with a crime ⑧ Other conduct that violates applicable law
Article 12 Management of Postings
① Responsibility for managing and operating the Site's postings and materials rests with the Operator. The Operator must monitor improper postings and materials at all times and, on discovering them or receiving a report, must delete the posting or material and warn the Member who registered it. Members are themselves responsible for the postings they upload, and must not publish postings that violate these Terms. ② Where a public body such as the Information and Communications Ethics Committee requests corrective action, the Operator may delete or move a posting without the Member's prior consent. ③ The criteria for improper postings are as follows:
Article 13 Retention of Postings
Where the Site's operator must discontinue the Site for unavoidable reasons, it will notify Members in advance and endeavour to take all measures to make it easy to transfer postings.
Article 14 Copyright in Postings
① Copyright in postings published on the Site by a Member belongs to the Member who published them. The Site may not use postings commercially without the poster's consent. This does not apply to non-commercial purposes, and the Site holds the right to publish the postings within the service. ② Members may not use materials published in the service commercially — for example by arbitrarily processing or selling information obtained through the service. ③ Where the Operator judges that content or postings registered or published by a Member fall under any item of Article 12, it may delete or move them, or refuse registration, without prior notice.
Article 15 Damages
① Primary civil and criminal liability arising on this Site rests with the Member concerned. ② No damages are payable where the harm suffered by a Member from this Site arises from force majeure such as a natural disaster, or from the Member's intent or negligence.
Article 16 Disclaimer
① The Operator is exempt from liability where a Member fails to obtain the benefits expected from the Site's provision of the service, or for damage arising from the Member's selection or use of service materials. ② The Operator is exempt from liability where the cause is a failure of this Site's service infrastructure or of telecommunications services provided by another carrier; damage relating to this Site's service infrastructure is governed by the Site's terms of use. ③ The Operator bears no liability whatsoever in connection with materials stored, posted, or transmitted by a Member. ④ The Operator is not liable where an impediment to use of the service arises from causes attributable to the Member. ⑤ The Operator is not liable for any activity between Members, between a Member and a third party, or otherwise carried out by a Member inside or outside this service (including data transmission and other community activity). ⑥ The Operator is not liable for the content — including the authenticity, reliability, or accuracy — of materials posted or transmitted by a Member or of any materials a Member may receive through this Site. ⑦ The Operator is not liable for any damage arising where Members, or a Member and a third party, trade goods through the service. ⑧ The Operator is not liable for any dispute arising between Members, or between a Member and a third party, without cause attributable to the Operator. ⑨ The Operator is not liable for a Member's damage arising from system failures that may occur without intent or gross negligence in the course of managing, inspecting, repairing, or replacing equipment such as servers, or in operating software; system failures caused by third-party attacks; the spread of computer viruses for which no countermeasure has been developed by reputable domestic or international research institutions or security companies; or other force majeure beyond the Operator's control.
